Procedure for issuing the "Single Residence and Work Permit"

The single residence and work permit/ ERP / is issued by the Ministry of Interior /MoI/ according to art. 24th law on foreigners in the
Republic Of Bulgaria/CDRB/. It also contains the positive written opinion provided by the executive director of the
Employment Agency for access to the Bulgarian labour market.

The ERP is issued to third-country nationals applying for a residence permit for the purpose of work. These are persons employed under an
employment relationship within the meaning of the Labour Code by a local employer.

The procedure for issuing the ERP complies with Directive
2011/98/EU on a single application procedure for third-country nationals for a single permit to stay and work
in the territory of a member state and on a common set of rights for third-country
workers legally residing in a member state.

The EPR shall be issued for a period of three years, and where the period of employment contract is shorter than three years, the authorisation shall be issued for the duration of the contract.
An alien with a permitted right of residence in to be outside the country when initially applying for an EPR territory of the Republic of Bulgaria.
The alien is not required to be outside the territory of the Republic Bulgaria and in a subsequent application for the EPRD.

And. Conditions for access to the labour market.

The conditions and procedure for access to the labour market are defined art. 24i of the LDRB, as well as in Chapter Two “labour migration from third
countries”, Section “General Provisions” and Section “single residence and work permit” of the labour migration
and labour mobility act (ltmtm).

Access to the labour market is allowed for positions for which Bulgarian citizenship is not required by law:

provided that the total number of third-country nationals with authorised long-term residence working for the local employer in the previous 12 months does not exceed 20% of the average number of employees under an employment relationship, but for small and medium-sized enterprises within the meaning of art. 3, Al. 1, vol. 1 of the small and medium-sized enterprises act-35%.
